These Terms of Service (“Terms”) govern your access to and use of the FillMap website and service at fillmap.app (the “Service”), operated by FillMap Technologies LLC (“FillMap”, “we”, “us”). By creating an account or using the Service, you agree to these Terms. If you are accepting on behalf of a clinic or other organization, you represent that you have authority to bind that organization, and “you” includes it.
1. The Service
FillMap is a drug-coverage reference tool. It aggregates publicly published formulary, plan, and pharmacy-network data (for example from CMS and Texas Health and Human Services) and answers questions such as whether a drug appears on a plan's formulary, what utilization-management prerequisites are listed, which pharmacies are listed as in-network, and what covered alternatives exist.
2. Not medical, legal, or benefits advice
THE SERVICE PROVIDES REFERENCE INFORMATION ONLY. IT IS NOT MEDICAL ADVICE, IS NOT A SUBSTITUTE FOR PROFESSIONAL CLINICAL JUDGMENT, AND IS NOT A GUARANTEE OF COVERAGE, PAYMENT, OR BENEFITS. Formularies and networks change, and the data we display may lag or contain errors. Always confirm coverage with the plan and exercise independent clinical judgment — including for any “alternative” suggestions, which may reference different medications. Prescribing decisions are solely the responsibility of the treating clinician.
3. No patient data (PHI)
The Service is designed to be used without protected health information. You agree not to enter, upload, or transmit any patient-identifying information (names, dates of birth, member IDs, medical record numbers, or any other PHI) into the Service. FillMap is not a HIPAA business associate and does not accept PHI; use of the Service does not create a business-associate relationship.
4. Accounts, organizations, and members
- You must provide accurate information and keep your credentials secure.
- The Service is organized around organizations. The person who creates an organization is its manager, holds the subscription, and controls seats, invitations, membership, and billing. If you set up an organization on behalf of a clinic or employer, you represent that you have authority to do so and to incur its charges.
- Managers add team members by sending one-time invite links. Each link enrolls a single person into the organization, works once, and expires. Do not forward an invite link to anyone it was not intended for.
- A free personal account lets an individual sign in, but does not provide access to lookups until that account is onboarded into an organization (via an invite link) or is turned into its own organization by starting a subscription. A user may belong to at most one organization at a time.
- Access is licensed per user. A subscription includes three (3) seats; additional seats may be purchased. Each member occupies a seat; the manager may choose whether their own account counts as one of the seats. The Service prevents adding more members than there are seats. You are responsible for activity under your account.
- A member may leave an organization at any time; a manager may remove any member. Accounts are for individual human users; do not share credentials or resell access.
- One active session per user. Because access is per user, only one device can be signed in to an account at a time. Signing in on a new device signs the account out of the previous one.
- API keys. Programmatic access, where FillMap makes it available, is via API keys. A key is personal to the account it is issued for, must be kept secret, is subject to the same lookup scope and rate limits as the app, and may be revoked. Do not share keys or use another person's key.
5. Fees, billing, and refunds
- The Service costs $100 per month per organization, which includes 3 seats, plus $25 per month for each additional seat. Prices may change with at least 30 days' notice, effective at your next billing cycle. Personal accounts that have not joined or started an organization are free.
- Payments are processed by Stripe; we do not store card numbers.
- Adding seats: extra seats added mid-cycle are prorated for the remainder of the period and charged immediately, then recur on future invoices.
- Removing seats: a seat removed within seven (7) days of when it was added is refunded (the prorated amount paid for it); otherwise the reduction simply takes effect on your next invoice with no refund. You cannot reduce seats below your organization's current number of members.
- 1-week easy refund: if you are not satisfied, cancel within seven (7) days of your first charge — directly from the billing page or by emailing support@fillmap.app — and we will refund it in full, no questions asked, and end access immediately.
- You may cancel at any time. Outside the 7-day window, cancellation takes effect at the end of the current billing period and fees already paid are non-refundable except where required by law.
6. Acceptable use
You agree not to:
- violate any law or third-party right while using the Service;
- probe, disrupt, or circumvent security or access controls (including seat limits, rate limits, single-session enforcement, or the lookup scope);
- scrape, bulk-export, enumerate, resell, or redistribute the Service or its compiled dataset, or access it by any automated means other than a personal API key used within its limits;
- use the Service to build a competing product;
- introduce malware or interfere with other users' use of the Service.
The Service applies per-account rate limits and monitors usage for abuse. We may throttle, and we may automatically lock an account whose usage is consistent with bulk extraction, pausing access pending review. Locked users are shown the reason and can request a review from within the app or at support@fillmap.app. Access is restored if the review clears; accounts used to violate this section may be suspended or terminated and are not entitled to a refund.
7. Data accuracy, sources, and availability
FillMap does not create coverage data. It aggregates information published by third parties — principally the Centers for Medicare & Medicaid Services (CMS), the Texas Health and Human Services Vendor Drug Program, and individual insurers' federally required machine-readable formulary files. We keep our copy synchronized with those sources (re-checking and re-ingesting them when they change) and each answer shows an “as of” date and its source.
The data is not, and cannot be, 100% accurate or complete. Our checks confirm that our copy matches what a source has published — not that the source itself is correct, current, or exhaustive. In practice this means:
- Formularies, coverage restrictions, and pharmacy networks change frequently, and a publisher's file may lag reality or contain its own errors or omissions.
- Sources update on their own, differing schedules (for example, some monthly, some weekly, some at each insurer's discretion), so different segments and plans may be current as of different dates.
- A given plan, drug, pharmacy, or “alternative” may be missing, delayed, mismatched, or shown differently than the plan would actually adjudicate it — including where a source is temporarily unavailable, incomplete, or does not publish the data at all (for example, ACA pharmacy networks).
Accordingly, the Service and its data are provided without any warranty of accuracy, completeness, timeliness, or availability. Always verify coverage, coverage restrictions, and network status directly with the plan before relying on it, and exercise independent clinical judgment (see Section 2). We may modify, suspend, or discontinue features or data sources with reasonable notice where practicable.
8. Intellectual property
FillMap and its software, design, and compiled datasets are owned by FillMap or its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service for your internal clinical-reference purposes during your subscription. Coverage information is derived from data published by the Centers for Medicare & Medicaid Services (CMS), the Texas HHSC Vendor Drug Program, individual insurers, the U.S. National Library of Medicine (RxNorm), and NPPES. That underlying data remains subject to its own terms and conditions, and FillMap is an independent product, not affiliated with or endorsed by those agencies.
9. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms (including entering PHI or violating acceptable use), for non-payment, or where required by law. Sections 2, 3, and 10–13 survive termination.
10. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FILLMAP WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE.
12. Indemnification
You will indemnify and hold FillMap harmless from claims arising out of your use of the Service in violation of these Terms, including any submission of PHI or any clinical decision made in reliance on the Service.
13. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Texas, and you consent to their jurisdiction.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced by email or in-app notice at least 14 days before they take effect; continued use after that constitutes acceptance.
